TERMS AND CONDITIONS

1. INTRODUCTION AND DEFINITIONS
1.1 These Terms and Conditions (“Terms”) govern the relationship between Sportovní hokejová s.r.o. (“we,” “us,” “our,” “HTC Prague,” “hockey-europe.com”), ID No.: 06420834, with registered office at Služeb 3451/3a, 108 00 Prague 10, Czech Republic, and you (“Client,” “Participant,” “Player,” “you”) regarding the use of our hockey training services and related activities.
1.2 Definitions:
  • “Services” means all hockey training programs, individual training plans, diagnostic testing, facility usage, and related activities offered by us through hockey-europe.com.
  • “Training Plan” means structured individual training programs categorized by age: Under 11, Under 14, and 15+.
  • “Tailor-Made Training” means customized individual or group training programs designed to specific client requirements.
  • “Additional Services” means supplementary services available upon request, including but not limited to use of our functional training zones (Skatemill, Stickhandling Zone, Shooting Zone, Functional Gym, Artificial Ice, and on-ice training).
  • “Facility” means HTC Prague Arena at Služeb 3451/3a, Prague 10.

2. OUR PRODUCTS AND SERVICES
2.1 Core Products: We offer the following standard training plans:
  • Under 11 Individual Training Plan – specialized program for players under 11 years of age
  • Under 14 Individual Training Plan – specialized program for players aged 11-14 years
  • 15+ Individual Training Plan – specialized program for players aged 15 years and older
  • Tailor-Made Individual or Group Training Plan – customized programs designed to meet specific individual or team requirements
2.2 Additional Services: Upon request and subject to availability, we may provide:
  • Individual on-ice training sessions
  • Skatemill training sessions
  • Stickhandling Zone access
  • Shooting Zone training
  • Functional Gym sessions
  • Artificial Ice training
  • Diagnostic and performance testing
  • Other hockey-related services as available
2.3 Service Availability: All Additional Services are provided subject to coach availability, facility capacity, and scheduling constraints. We do not guarantee the availability of any specific Additional Service at the time of request.

3. BOOKING AND REGISTRATION
3.1 Reservation Process: All bookings for Training Plans and Services must be made through our website at hockey-europe.com or via email at customer@htcpraha.cz A binding contract is formed upon confirmation of your order and receipt of payment.
3.2 Required Information: When registering, you must provide accurate and complete information including:
  • Full name and date of birth of the participant
  • Contact details (email, phone number)
  • Emergency contact information
  • Medical information relevant to participation in physical activities
  • Hockey experience level and specific training goals
  • Any physical limitations or health conditions
3.3 Age Verification: By booking an age-specific Training Plan, you confirm that the participant meets the age requirements. We reserve the right to verify age and reassign the participant to the appropriate program category if necessary.
3.4 Tailor-Made Programs: For customized training plans, we will conduct an initial consultation (in person or remotely) to assess needs, goals, and availability before finalizing the program structure and schedule.

4. PAYMENT TERMS
4.1 Payment Obligation: Full payment for Training Plans and Services is required as specified at the time of booking, unless otherwise agreed in writing.
4.2 Payment Methods: We accept payment via bank transfer, credit/debit card through our secure payment gateway, or other methods as specified on our website.
4.3 Payment Schedule: For multi-session Training Plans or extended Tailor-Made programs, we may agree to installment payments. Any such arrangement must be confirmed in writing and adhered to strictly.
4.4 Late Payments: Failure to make timely payment may result in suspension of Services until payment is received, or termination of the contract with applicable cancellation fees.

5. CANCELLATION AND REFUND POLICY
5.1 Client Cancellations – Training Plans:
  • More than 14 days before start date: Full refund minus administrative processing fee
  • 7-14 days before start date: 50% refund of total program fee
  • Less than 7 days before start date: No refund (0%)
5.2 Client Cancellations – Individual Sessions: Cancellation of any scheduled individual training session must be made at least 24 hours in advance. Cancellations made less than 24 hours before the scheduled session, or failure to attend (no-show), will result in full charge for that session.
5.3 Our Cancellations: We reserve the right to cancel or reschedule any Training Plan or Service due to insufficient participants, coach unavailability, facility issues, force majeure, or operational requirements. In such cases, you will be offered:
  • A full refund, or
  • Transfer to alternative dates, or
  • Credit for future Services
5.4 Medical Cancellations: If you cannot attend due to documented medical reasons preventing participation in physical activity, we may offer prorated refund or credit for future Services at our discretion, provided we receive valid medical documentation prior to the scheduled start date.
5.5 Program Modifications: We reserve the right to modify Training Plan schedules, coaches, or specific activities due to operational needs, while maintaining the overall scope and quality of the program.

6. PARTICIPANT RESPONSIBILITIES AND CONDUCT
6.1 Medical Fitness: By participating in any Service, you confirm that you (or the minor participant under your guardianship):
  • Are physically fit to engage in intensive hockey training and physical exercise
  • Have no medical conditions that would prevent safe participation
  • Have disclosed all relevant medical information, injuries, or physical limitations to us
  • Understand that ice hockey and related training involve inherent risks of injury
6.2 Equipment Requirements: Participants must provide appropriate equipment for all activities:
  • On-ice sessions: Complete hockey equipment including helmet, pads, gloves, skates, and stick
  • Off-ice training: Clean indoor athletic shoes, athletic wear, towel, and water bottle
  • Specific zones: Equipment as advised by coaches for Skatemill, Stickhandling, Shooting, or Functional Gym sessions
6.3 Code of Conduct: All participants must:
  • Follow coaches’ and staff instructions at all times
  • Respect fellow participants, coaches, staff, and facility property
  • Arrive on time for all scheduled sessions
  • Maintain appropriate hygiene and safety standards
  • Not engage in dangerous, abusive, discriminatory, or disruptive behavior
6.4 Prohibited Conduct: The following are strictly prohibited at our Facility:
  • Use of alcohol, drugs, or performance-enhancing substances
  • Smoking or vaping within the Facility premises
  • Dangerous play or intentional injury to others
  • Theft, vandalism, or misuse of equipment
  • Any illegal activities
Violation of these rules will result in immediate removal from the Facility and termination of Services without refund.

7. LIABILITY, RISK, AND INSURANCE
7.1 Assumption of Risk: You acknowledge that ice hockey training, off-ice conditioning, and use of training equipment involve inherent risks including, but not limited to, muscle strains, sprains, fractures, concussions, and other serious injuries. You voluntarily assume all risks associated with participation in our Services.
7.2 Medical Emergency: In case of medical emergency, we will attempt to contact emergency contacts immediately. If necessary, we will arrange emergency medical treatment, including ambulance transport. You are responsible for all costs associated with emergency medical care.
7.3 Liability Limitation: To the fullest extent permitted by Czech law:
  • We are not liable for injuries resulting from inherent risks of hockey training and physical exercise
  • Our total liability for any claim arising from our Services shall not exceed the amount actually paid by you for the specific Service giving rise to the claim
  • We are not liable for loss, theft, or damage to personal property brought to our Facility
  • We are not liable for indirect, consequential, or punitive damages
7.4 Insurance: We strongly recommend that all participants maintain adequate health, accident, and personal liability insurance covering sports activities. We do not provide personal accident insurance for participants.
7.5 Force Majeure: We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, epidemics, government restrictions, wars, terrorism, facility damage, or other force majeure events.

8. INTELLECTUAL PROPERTY AND MEDIA
8.1 Recording of Sessions: We reserve the right to photograph, video record, or otherwise document training sessions for:
  • Training analysis and player development feedback
  • Promotional and marketing purposes on our website and social media
  • Quality assurance and coach training
8.2 Media Consent: By participating in our Services, you grant us a perpetual, royalty-free, worldwide license to use photographs, video footage, and testimonials featuring you (or your minor child) for promotional, educational, and commercial purposes, unless you explicitly object in writing prior to participation.
8.3 Personal Recording: Participants may not record coaches, other participants, or facility operations without prior written consent. Personal use of recordings for individual training purposes may be permitted with coach approval.

9. PERSONAL DATA PROTECTION
9.1 Data Processing: Your personal data is collected and processed in accordance with our Privacy Policy and applicable data protection laws, including Regulation (EU) 2016/679 (GDPR). By using our Services, you consent to such processing as described in our Privacy Policy.
9.2 Purpose of Data: We process personal data for:
  • Service provision and administration
  • Communication regarding schedules and programs
  • Emergency contact and medical safety
  • Payment processing
  • Legal compliance and record keeping
  • Marketing communications (with your consent)
9.3 Medical Data: Health and medical information provided is used solely for safety purposes, tailoring training programs to individual needs, and emergency situations. This data is treated with strict confidentiality and accessed only by authorized personnel.

10. COMPLAINTS AND DISPUTE RESOLUTION
10.1 Complaints: If you are dissatisfied with any aspect of our Services, please submit a written complaint to info@hockey-europe.com or to our registered address. We will acknowledge receipt within 5 business days and provide a substantive response within 30 days.
10.2 Good Faith Negotiation: Both parties agree to attempt to resolve any dispute through good faith negotiation before pursuing formal legal remedies.
10.3 Governing Law: These Terms are governed by the laws of the Czech Republic.
10.4 Jurisdiction: Any disputes arising from these Terms or our Services shall be resolved exclusively by the competent courts of the Czech Republic, specifically the Municipal Court in Prague.
10.5 Consumer Protection: If you are a consumer, nothing in these Terms affects your statutory rights under Czech and EU consumer protection law.

11. FINAL PROVISIONS
11.1 Amendments: We reserve the right to modify these Terms at any time. The current version is always available at hockey-europe.com. Continued use of our Services after changes constitutes acceptance of the revised Terms.
11.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.3 Entire Agreement: These Terms, together with any specific written agreements regarding Tailor-Made programs, constitute the entire agreement between you and us regarding our Services.
11.4 Assignment: You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
